§ 7.491. Inspection of waste transportation vehicles.

 The Department of Environmental Resources, the Department of Transportation and the State Police will cooperate to inspect and investigate vehicles transporting solid waste into and through this Commonwealth. Commercial waste transportation vehicles shall be inspected to determine:

   (1)  Whether the vehicles are transporting waste from transfer facilities or other sources that are operating in violation of the solid waste laws of the Commonwealth or of the states where the waste was generated or transported.

   (2)  Whether the vehicles are transporting waste in violation of the solid waste laws or plans of the state or a subdivision thereof where the waste was generated.

   (3)  Whether the vehicles are operating in compliance with the motor vehicle and road safety laws of the Commonwealth and the rules, regulations and orders of the Department of Transportation and the State Police.

   (4)  Whether the vehicles are operating in compliance with the solid waste laws of the Commonwealth, rules and regulations thereunder, and in compliance with the orders of the Department of Environmental Resources.

   (5)  Whether the vehicles are operating in a manner that adversely affects or endangers the public health, safety and welfare, or the environment through which the transportation occurs.
