Notes of Decisions Sentence Outside Guidelenes Recommendations
Where the defendant fired a deadly weapon in connection with the offense to which he entered a guilty plea, and the court noted the standard range in light of the deadly weapon enhancement, the courts imposition of a sentence beyond the standard range was an abuse of discretion where the record indicates the judge failed to consider all factors relevant to the determination of a proper sentence. Commonwealth v. Ritchey, 779 A.2d 1183 (Pa. Super. 2001).
