§ 1.10-1010. Declaration of a Vacancy.

 Whenever facts or circumstances exist which result in the vacancy of an elective* office as provided for by law, the Board shall, by the affirmative vote of at least a majority of the Board in office, declare such office vacant and proceed to fill the vacancy as provided in this Charter. In the event that the Board fails to declare the existence of a vacancy, an action may be brought in the Court of Common Pleas of Lehigh County to determine whether or not a vacancy exists. In the event that the Court determines that a vacancy exists, said vacancy shall be filled in accordance with the provisions of this Charter as they apply to the filling of vacancies.
