§ 9.21. Implementation by the Secretary.

 (a)  The Secretary shall be responsible for the development of a Commonwealth plan for educational broadcasting, in accordance with sections 523 and 525 of the Public School Code of 1949 (24 P. S. § §  5-523 and 5-525).

 (b)  The Secretary shall insure that there is full educational utilization of the noncommercial broadcasting stations, commercial stations, and cable television systems where feasible; as well as the development of all available Federal Communications Commission educational allocations; and the application for new educational allocations as needed.

 (c)  Closed-circuit television systems and other origination and distribution facilities may be developed at state colleges and universities, school districts, and intermediate units with the approval of the Secretary. These facilities may be integrated with the existing State educational-public television network and with each other and with commercial and noncommercial stations to form a statewide educational service.

§ 9.22. Channel and frequency allocations.

 The Secretary shall assist in the application to the Federal Communications Commission for allocations consistent with the Commonwealth plans for their educational use.

§ 9.23. Pilot education projects.

 The Secretary may conduct pilot, experimental and innovative projects in educational broadcasting, closed-circuit television, cable television, and other origination and distribution facilities to further the development of the Commonwealth goals for education.

§ 9.24. Broadcasting service areas.

 (a)  A broadcasting service area shall be an area in which engineering ‘‘class A’’ signals (as defined by the Federal Communications Commission) are received and used from one or more broadcasting facilities.

 (b)  Broadcasting service areas shall include the following:

   (1)  WHYY-TV, Philadelphia: School districts within the counties of Philadelphia, Delaware, Chester, Montgomery, and Bucks.

   (2)  WQED-TV and WQEX-TV, Pittsburgh: School districts within the counties of Allegheny, Beaver, Butler, Westmoreland, Washington, Greene, Fayette, Armstrong, Indiana, Lawrence, Mercer, Venango, Clarion, and Jefferson.

   (3)  WITF-TV, Harrisburg: School districts within the counties of Dauphin, Cumberland, York, Lancaster, Lebanon, Perry, Adams, Franklin, and Juniata.

   (4)  WPSX-TV, Clearfield: School districts within the counties of Centre, Clearfield, Clinton, Mifflin, McKean, Potter, Elk, Cameron, Cambria, Blair, Bedford, Fulton, Somerset and Huntingdon.

   (5)  WLVT-TV, Allentown: School districts within the counties of Northampton, Lehigh, Berks, Carbon, Monroe and Pike.

   (6)  WVIA-TV, Wilkes-Barre-Scranton: School districts within the counties of Luzerne, Lackawanna, Wayne, Wyoming, Columbia, Montour, Northumberland, Snyder, Union, Lycoming, Sullivan, Bradford, Susquehanna, Schuylkill and Tioga.

   (7)  WQLN-TV, Erie: School districts within the counties of Erie, Warren, Crawford and Forest.

§ 9.25. Regional Educational Broadcasting Councils.

 A Regional Educational Broadcasting Council shall be a nonprofit corporation established, with the approval of the Secretary for the purposes of:

   (1)  Establishing and coordinating educational broadcasting program needs.

   (2)  Improving use of educational radio and television.

   (3)  Evaluating the effectiveness of educational radio and television.

   (4)  Procuring program services necessary for educational broadcasting.

§ 9.26. Administration of service areas.

 A broadcasting service area shall be administered by a Regional Educational Broadcasting Council in accordance with standards approved by the Secretary, the corporate laws of this Commonwealth and; where applicable, the regulations of the Federal Communications Commission.

§ 9.27. Programming.

 Programs developed by a Regional Educational Broadcasting Council and financed in whole or in part by Departmental and Federal educational funds shall be subject to the approval of the Secretary and be available to students in this Commonwealth.
