§ 295.233. Sale, utilization or disposal of compost.

 Prior to sale or utilization of compost, the operator shall obtain a general beneficial use permit from the Department under Chapter 287, Subchapter H (relating to beneficial use) or a determination by the Department under §  287.7 (relating to determination that a material is no longer a waste) that the compost, if used in accordance with the terms and conditions of the composting facility permit, is no longer a waste. Prior to disposal of compost, the operator shall obtain written approval from the Department, based on a chemical analysis of the compost, on forms provided by the Department. If the Department determines that the compost has the potential for causing air, water or land pollution, the Department will notify the operator that the compost is to be disposed of at a permitted disposal facility.
